One Death Too Many!

In the summer of 2010, two young children died within days of each other after being crushed by sliding electric gates in separate incidents, only four years earlier a nine-year-old boy had also been crushed to death by an electric swing gate.

Two other children narrowly avoided serious injury following unrelated accidents in July and September of 2010,

Yet the number of near-misses could be much higher because the government stopped collecting injury causation data in 2002, RoSPA is only aware of those incidents which are reported by the media.

The two most recent deaths sparked a strong response in the national press and prompted experts in the field to take a closer look at the safety protocols and product standards that guide the design, manufacture, installation, use and maintenance of automated and semi-automated gates.

Subsequently, the Health and Safety Executive (HSE) issued new safety advice to the industry in September 2010.

Owners and occupiers of commercial premises with powered gates have duties under the Workplace (Health, Safety and Welfare) Regulations 1992. These include basic safety by construction (Regulation 18) and maintenance (Regulation 5). They may also have duties under Section 3 of the Health and Safety at Work etc Act 1974 for the safety of persons (including the public) they do not employ.

 

While the responsibility for safe gate design/construction and installation may rest with others, the owner/user should ensure that the installed product is safe, and kept safe. In particular, they should study the User Instructions that come with the product, assessing what servicing and inspection/safety checks may be necessary.

 

While health and safety law does not apply to owners of powered gates on domestic (privately owned) premises, it is strongly recommended that they are checked regularly.
